SPOUSAL SUPPORT Due to increasing changes in the law and in society, including changes in sexual equality, this area of the law of divorce is in a process of continuing change. Whether or not spousal support should be paid by the husband or wife depends upon who caused the divorce and other factors such as the respective ages, assets, earning potential and the duration and history of the marriage. It is important to remember that spousal support is not used as punishment but is designed to lessen the financial impact of the divorce on the economically dependent spouse.
